A SUCCESSFUL appeal in the US that surfaced two weeks ago promises a “back to the future” change in the way creditors’ rights are enforced in maritime cases worldwide.
The US Court of Appeals has reversed a 2002 ruling that allowed creditors to freeze electronic fund transfers passing through New York as security against alleged defaults under Rule B for claims in the Federal Rules of Civil Procedure.
